LUSH APP AND LUSH ACCOUNT CANADA REWARD PROMOTION DECEMBER 2024

PROMOTER: Lush Handmade Cosmetic Ltd a company registered in British Columbia, Canada,

whose registered office address is at: 8680 Cambie St, Vancouver, BC V6P 6M9 (the “Promoterˮ).

PROMOTION: Download the LUSH App and create a LUSH account to receive a CDN$5.00

voucher (the “Rewardˮ) for use against your next purchase in the LUSH App or in participating

Canadian LUSH stores; or be an existing LUSH Account holder on the latest version of the LUSH

App (the “Rewardˮ) during the Promotion Period (the “Promotionˮ). Minimum spend of CDN$1.00 applies.

PROMOTION PERIOD: This Promotion launches on the LUSH App on December 11, 2024, at 09:00 AM EST and closes on December 23, 2024, at 12:00 AM EST.

HOW TO ENTER: In order to participate in the Promotion you must complete the following steps:

1. Download the latest version of the LUSH App

a. For iOS device users, this is accessible on the Apple App Store. You will require a

device with iOS 16.0 or later. For Android device users, this is accessible on Google

Play. You will require a device with Android 9 (API 28).

b. If you already have the LUSH App downloaded on your device, make sure you have

the latest version. You will require the latest version of the LUSH App to participate

in this Promotion.

c. The ways in which you can use the LUSH App and may also be controlled by the

Google Play Store Terms of Service and the Apple App Store Terms of Service will

apply instead of these terms where there are differences between the two.

2. Create a LUSH account / Log in to your LUSH account

a. Click on “Sign Upˮ if you do not already have a LUSH account. You will be asked

to supply your email address and choose a password. You are given the option to

sign up the Lush Community newsletter. You do not have to sign up to the

newsletter in order to participate. If you choose to sign up to the newsletter, you

can unsubscribe at any time.

OR

b. Click on “Log inˮ if you already have a LUSH account and enter your email address

and password associated with your LUSH account.

3. Claiming the Reward: Ensure you are logged into your LUSH account on the latest version

of the LUSH App. The Reward will appear in your LUSH App as a banner on your home

feed and it will also appear in the “Rewardsˮ section of your checkout basket page.

HOW TO REDEEM THE REWARD

4. Who can redeem the Reward? The Reward may not be claimed by a third party on the

participantʼs behalf. The Promoter does not accept any responsibility if the participant is

not able to take up the Reward.

5. Where can the Reward be redeemed? The Reward will be available for redemption on

any eligible online purchase made through the LUSH App or in participating Canadian

LUSH stores.

6. How can I redeem the Reward?

a. Online: You can redeem the Reward from your checkout basket on the LUSH App,

you simply need to click on “Apply Rewardˮ and the Reward will be applied to your

checkout basket if your shopping basket sub total is equal to or more than $1.00.

This will automatically deduct $5.00 from your shopping basket total. The $5

reward will not apply against shipping fees. If the value of your basket sub-total

is less than the Reward, the remaining balance of the Reward will be lost.

b. In Store: In these participating Canadian LUSH stores only; Metrotown, Robson, Toronto Eaton Centre, Lime Ridge, Scarborough, and Queen Street West. You simply need to present to a member of staff (a) your LUSH App homepage showing the Reward banner; and (b) confirm your email address associated with your Lush Account when placing an in-store order.

7. What products are excluded from the Reward? Any sale items; charity products; campaign

products raising funds for charities or non-profit organisations; gift cards; in store spa vouchers;

all subscription services; all customisation services; all lifestyle items (including but not limited

to such as clothing, tote bags and cosmetics pouches); knot wraps, Lush paper carrier bags

and make-up brushes and any shipping fees. For the avoidance of doubt, LUSH Spa vouchers

can be purchased using the Reward through the LUSH App.

THE REWARD TERMS

8. The Reward cannot be exchanged, refunded or transferred to another person or

redeemed for cash.

9. Expiry Date: The Reward will expire 3 months from the date it was unlocked through this

Promotion.

10. The Reward can only be used once. Once it has been used, it will disappear from your

LUSH App.

11. The Reward cannot be used in conjunction with other discounts or offers.

ELIGIBILITY

12. The Promotion is only available to participants resident in the Canada (excluding those

resident in Quebec).

13. Sorry, you are not eligible to participate if you are:

a. an employee of the Promoter and its associated companies or group companies;

b. anyone professionally associated with the Promotion; or

c. members of the immediate families or households of (a) and (b) above.

14. The Promoter reserves the right at its sole discretion to disqualify from further participation

in the Promotion any individual it has reason to believe is tampering with the operation of

the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of

these Terms, relevant laws and/or regulations and/or third party rights.

15. Each participant is eligible for only one Reward.

LIMITATION OF LIABILITY

16. The Promoter is not responsible for any damage or loss suffered by any participant where

such damage or loss was not, at the time the entry into the Promotion was made, a reasonably foreseeable consequence of a breach of these Terms, or where the Promotion

does not run as planned.

17. The Promoter will not be held responsible for the failure to fulfil the obligations of third

parties involved in this Promotion, although the Promoter will always endeavour to

minimise the effect to the participants of any such failure.

18.The Promoter will not accept responsibility any inability of a participant to access or use

the Reward, regardless of cause, including, for example as a result of any equipment

failure, technical malfunction, systems, satellite, network, server, computer hardware or

software failure of any kind.

19. By participating in the Promotion, the participant indemnifies the Promoter against any and

all actions, claims, damages, expenses or liabilities suffered or incurred directly or

indirectly by us in consequence of any breach or alleged breach, non-performance or non

-observation by the participant of any agreement, conditions, obligation or warranty on the

part of the participant herein. The participant hereby waives and releases the Promoter

and each of its parent, affiliated, subsidiary and/or related entities and parties from any

claim, action or demand arising out of or in connection with the Promotion.

20. Nothing in these Terms and Conditions shall operate to exclude the Promoterʼs liability:

a. For death or personal injury as a result of the Promoterʼs negligence;

b. For fraud;

c. Further than that is permitted by law.

DATA PROTECTION

21. By participating in the Promotion, participants acknowledge that the Promoter (and its

group companies on its behalf), may process, store, distribute and/or use the information

(including personal data) participants provide in their entry and in the process of

redeeming the Reward for the purpose of administering this Promotion.

GENERAL

23. By participating in the Promotion, all participants will be deemed to have read, accepted

and be bound by these Terms and any other requirements set out in the promotional

material for the Promotion (in the event of a conflict, the requirements set out in the

promotional material will take precedence), as well as all applicable laws and regulations,

including without limitation those governing copyright, content, defamation, privacy,

publicity and the access or use of othersʼ computer or communication systems.

24. The Promotion is free to enter, no purchase is necessary.

25. The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion

where it becomes necessary to do so without prior notice.

26. The Promoter reserves the right to cancel or amend these Terms at any time without prior

Notice.

27. The Promoter shall be entitled to assign the benefit of these terms either in whole or in part

to any of its subsidiary or associated bodies or successors in title and/or any third party.

28. These Terms shall be governed by British Columbia law, and the parties submit to the

exclusive jurisdiction of the courts of British Columbia
