1. Introduction
These terms and conditions (the “Terms”) apply to the “Spot the Croc” promotion running from 23 November 2023 to 31 December 2023 in the Lush Times.
2. The Promoter
Lush Ltd a company registered in England and Wales with company number 02940032, whose registered office is at 29 High Street, Poole, Dorset, BH15 1AB (the “Promoter”).
3. The Promotion
3.1. Readers of the Lush Times are invited to count all the crocodiles that appear in the November 2023 issue of the Lush Times magazine and email [email protected] with page numbers of where the crocodiles appear in the issue. Please include ‘SPOT THE CROC’ in the subject line of the email.
3.2. Each correct answer will be entered into a prize draw for the chance to win a Croc bath bomb as detailed in the promotion on the Lush Times (the “Prize Draw”).
4. Free Entry and No Purchase Required:
4.1. The prize draw is free to enter and no purchase is required to participate.
4.2. Receipt of a Prize will not incur you additional delivery costs.
5. Entry Requirements:
5.1. All entries must be submitted via email sent to [email protected] and only one entry per person is permitted.
5.2. The opening date for entries is midnight GMT on 23rd November 2023. The closing date of the prize draw is midnight GMT on 31 December 2023. Entries received after this time will not be valid.
6. Lost or Delayed Entries:
The Promoter will not accept responsibility for entries not successfully completed or lost, regardless of cause, including for example as a result of technical fault, technical malfunction, equipment failure, computer hardware or software failure, satellite, network or server failure of any kind.
7. Prize:
7.1. The winners will receive one (1) Crocodile shaped bath bomb each. This is not available for sale in our stores.
7.2. There will be forty (40) winners chosen by an independent, random computer process.
7.2. There is no cash alternative for the Prize and the Promoter reserves the right to substitute the Prize with a gift of equal or greater value.
7.3. The Prize cannot be exchanged, transferred to another person; and no cash alternative is offered.
8. Notification of Winning:
The winner will be notified by the email they used to enter before 9th January GMT and must provide a postal address to claim their prize. If a winner does not respond to the Promoter within seven (7) days of being notified by the Promoter, then the winner’s prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
9. Receipt of the Prize
9.1. The Prize will be sent to the winners by post no later than 30 days after being notified of their win.
9.2. By participating in the Prize Draw, all participants will be deemed to have read, accepted and be bound by these Terms and any other requirements set out in the promotional material for the Promotion (in the event of a conflict, the requirements set out in the promotional material will take precedence), as well as all applicable laws and regulations, including without limitation those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
10. Announcement of Winner:
The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails [email protected] up to one (1) month after the closing date stated in these terms and conditions. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter [email protected]. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
11. Eligibility
11.1. The promotion is only open to readers of the Lush Times who picked up their copy of the Lush Times from Lush stores in the following countries: Austria, Canada, Czech Republic, France, Germany, Ireland, Japan, North America, United Kingdom (excluding Northern Ireland) (each an “Eligible Territory”).
11.2. Sorry, you are not eligible to participate in the promotion if you are:
(a) under 18 years old;
(b) employees of the Promoter and its associated companies or group companies;
(c) anyone professionally associated with the Promotion; or
(d)) members of the immediate families or households of (b) and (c) above.
11.3. The Promoter reserves the right at its sole discretion to disqualify from further participation in the Promotion any individual it has reason to believe is tampering with the operation of the Promotion, or to be acting in any manner deemed by the Promoter to be in violation of these Terms, relevant laws and/or regulations and/or third-party rights.
12. Limitation of Liability
12.1. The Promoter is not responsible for any damage or loss suffered by any participant where such damage or loss was not, at the time the entry into the Promotion was made, a reasonably foreseeable consequence of a breach of these Terms, or where the Promotion does not run as planned.
12.2. The Promoter will not be held responsible for the failure to fulfil the obligations of third parties involved in this Promotion, although the Promoter will always endeavour to minimise the effect to the participants of any such failure.
12.3. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the Prize to anyone in breach of these terms and conditions.
12.4. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so.
12.5. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
13. Data Protection and Publicity
13.1. Personal data supplied during the course of this promotion will only be processed as set out in the Promoter’s Privacy Policy for each eligible territory (see links below). See also Condition 10. with regard to the announcement of winners:

14. General:
These Terms shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales. This does not affect your statutory rights to have any dispute heard in the courts of the Eligible Territory that you live in.
