SpongeBob Musical Tickets Prize Terms

1. How to enter

1.1 The competition to win tickets to SpongeBob Musical will run from 08:00 on Friday 28 July 2023 (the "Opening Date") to 24:00 on Sunday 30 July 2023 (the "Closing Date") inclusive.

1.2 All competition entries must be received by the promoter, Lush Limited of 29 High Street, Poole, Dorset, BH15 1AB (“Lush”) by no later than 24:00 on the Closing Date. All entries received after the Closing Date are automatically disqualified.

1.3 Entry to this competition is free, to enter the competition:

(a) simply enter your email address on the pop up on our website, www.lush.com and then download the Lush Fresh Handmade Cosmetics App from Apple or Google Play, before the Closing Date.

(b) if you are unable to download the App, or for help with entering please email us at [email protected] or, on (+44) 1202 930051 with the Subject Heading “SpongeBob Musical Competition” and your name, address and contact number to be received before the Closing Date.

1.4 There is no purchase necessary and there is no charge to register for and use the Lush App.

1.5 Lush will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

1.6 By downloading the Lush App via the website pop-up, you are agreeing to be bound by these terms and conditions.

2. Eligibility

2.1 The competition is only open to all residents in the United Kingdom aged 18 years or over, except

(a) employees of Lush or its holding or subsidiary companies, (b) employees of agents or suppliers of Lush or its holding or subsidiary companies, who are professionally connected with the competition or its administration; members of the immediate families or households of (a) and (b).

2.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. Lush may require you to provide proof that you are eligible to enter the competition.

2.3 Lush will not accept competition entries that are (a) automatically generated by computer, (b) completed by third parties or in bulk, (c) illegible, have been altered, reconstructed, forged or tampered with, or (d) incomplete.

2.4 There is a limit of one entry to the competition per person. One entrant can only win a maximum of one prize. Entries on behalf of another person will not be accepted.

2.5 You must have consent of the mobile phone owner to download the Lush App.

3. The prize

3.1 The prize is to win one (1) pair of tickets for SpongeBob the musical and five (5) are available to be won.

3.2 The musical is taking place at the following venues Southbank Centre, Queen Elizbeth Hall, London, Theatre Royal Plymouth, Newcastle theatre Royal please check the following link for dates https://www.spongebobstage.com/tour-dates. Lush cannot guarantee the availability of locations and dates and the winners will be required to make their bookings directly.

3.3 Lush will not be responsible if the musical is delayed, cancelled or any equivalent event.

3.5 The prize is not negotiable or transferable. There is no cash alternative for the prize.

3.6 We will either post or email you your prize at our discretion. We are not responsible if you do not receive your prize for any reason, including, if you give us an incorrect email or postal address, or if the email goes into your junk/spam folder.

4. Winners

4.1 Winners will be selected at random by Lush and the decision of Lush is final, and no correspondence or discussion will be entered into.

4.2 Lush will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry.

4.3 Lush must either publish or make available information that indicates that a valid award took place. To comply with this obligation Lush will send the surname and county of major prize winners to anyone who emails [email protected] within one month after the Closing Date.

4.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact Lush https://www.lush.com/uk/en/faq/contact-us In such circumstances, Lush must still provide the information and winning entry to the Advertising Standards Authority on request.

5. Claiming the prize

5.1 Please allow 7 days for delivery of the prize.

5.2 The prize may not be claimed by a third party on your behalf.

5.3 If the prize cannot be delivered, Lush reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

5.4 Lush does not accept any responsibility if you are not able to take up the prize.

6. Limitation of liability

Insofar as is permitted by law, Lush, its subsidiaries and holding companies, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Lush, its subsidiaries or holding company, its agents or distributors or that of their employees. Your statutory rights are not affected.

7. Ownership of competition entries and intellectual property rights

You agree that Lush may, but is not required to, make your entry available on its website www.lush.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant Lush a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry for such purposes.

8. Data protection and publicity

Lush will only process your personal information as set out in the www.lush.com/uk/en/faq/privacy-notice See also above, with regard to the announcement of winners.

9. General

9.1 If there is any reason to believe that there has been a breach of these terms and conditions, Lush may, at its sole discretion, reserve the right to exclude you from participating in the competition.

9.2 Lush reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

9.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
