LUSH PROMOTIONAL GIFT CARDS

TERMS & CONDITIONS

These LUSH Promotional Gift Card Terms and Conditions (“Promotional Card Terms”) apply in addition to the Terms of Use and Privacy Policy set forth on the Lush.com website, which are expressly incorporated herein. These Promotional Card Terms govern your acceptance and use of any promotional gift card (a “Promotional Gift Card”) issued by Lush Cosmetics North America or any related or affiliated entity (“Lush”). By accepting or using a Promotional Gift Card, you agree to be bound by these Promotional Card Terms.

1. Promotional Gift Card Balance. You may obtain information on the balance of your Promotional Gift Card at any Lush store location or by calling 1-888-205-5787.

2. Expiration Date: All funds associated with your Promotional Gift Card expire on December 31, 2023.

3. Acceptance Locations. This Card is redeemable only for products and services available at Lush Fresh Handmade Cosmetics locations in Canada, the US and Puerto Rice, online at lush.com/us and lush.com/ca or by calling 1-888-205-5787.

4. Redemption. Promotional Gift Cards may only be redeemed toward the purchase of eligible goods and services provided by Lush. Eligible goods and services are subject to change in Lush’s sole discretion. Redemption of Promotional Gift Cards at any affiliated property is subject to change in our sole discretion. Promotional Gift Cards cannot be redeemed for cash.

5. Limitations & Reloading. Your Promotional Gift Card cannot be used to purchase other gift cards or gift certificates offered by Lush. Promotional Gift Cards cannot be reloaded. Promotional Gift Cards cannot be used to the purchase of goods or services at any Lush-affiliated location outside of the United States.

6. Not Eligible for Returns or Resale. Promotional Gift Cards are not returnable or refundable. Resale of Promotional Gift Cards is strictly prohibited.

7. Unused Funds. Any unused fund associated with the Promotional Gift Cards will expire on the expiration date described above. Unused funds cannot be redeemed for cash.

8. Risk of Loss. By accepting a Promotional Gift Card, you assume all risk of loss and title for the Promotional Gift Card. You are responsible for safeguarding your Promotional Gift Card and for any unauthorized use. If your Promotional Gift Card is lost, stolen, or destroyed, or if the funds associated with your Promotional Gift Card are used without your permission, Lush is not responsible and Lush will not be obligated to replace your Promotional Gift Card or otherwise refund you any funds associated with your Promotional Gift Card. Lush is not responsible for, and assumes no liability to you for, any unlawful conduct or fraud by any third party associated with any Promotional Gift Card.

9. Fraud & Termination. You agree not to use any Promotional Gift Card in any way that is misleading, deceptive, unfair, unlawful, or otherwise harmful to Lush. Lush reserves the right, without notice to you, to void any Promotional Gift Card without a refund, or cancel or limit any orders or purchases made with Promotional Gift Cards.

10. Limitation of Liability. To the fullest extent permissible by law, Lush makes no warranties, express or implied, concerning any Promotional Gift Card. Lush is not responsible for or liable for any inability by you to use the Promotional Gift Card due to issues associated with any Lush store location or website or due to issues associated with payment systems outages or issues.

11. Disputes. Any dispute or claim related to any Promotional Gift Card will be resolved in accordance with the Lush Terms and Conditions.

12. Additional Provisions. Lush reserves the right to change these Promotional Card Terms without notice, from time to time at Lush’s sole discretion. All terms and conditions are applicable to the extent permitted by law. If any of these terms and conditions are deemed invalid, void, or for any reason unenforceable, that unenforceable term will be deemed severable and will not affect the validity and enforceability of any remaining these Promotional Card Terms.
