THIS LIMITED TIME GIVEAWAY IS CONDUCTED WHILE SUPPLIES LAST, ON A FIRST-COME, FIRST SERVED BASIS, WITH PROOF OF QUALIFIED. THIS GIVEAWAY IS NEITHER A GAME OF CHANCE NOR A GAME OF SKILL. PURCHASE IS NECESSARY TO RECEIVE GIFT, COLLECT IN-STORE PURCHASES ARE EXCLUDED FROM THIS GIVEAWAY.
1. Eligibility: The Lush Treat, No Trick Online Product With Purchase Giveaway (the "Giveaway") is open only to legal residents of the United States & Canada who are at least 18 years old at the time of purchase, who have made a Qualified Purchase (each, a "Qualified Purchaser"). The Giveaway is void where prohibited by law. The Giveaway is subject to all applicable federal, state and local laws.
2. Sponsor/Administrator: The sponsor and Administrator of this Giveaway is Lush Internet Inc.
3. Giveaway Period: This Giveaway is offered on the Lush App on October 23, 2023, starting at 9:00 AM EST and ending upon the earlier of (i) October 31, 2023, at 11:59 PM EST or (ii) until such time that all gifts have been given to Qualified Purchasers.
4. How to Enter: To participate in this Giveaway, you must visit the LUSH ANDROID OR IOS APP (https://www.lush.com/us/en_us). The Qualified Purchase must fulfill all Giveaway requirements, as specified, including purchase of Lush online product, name, email, year of birth, and address to be eligible to receive a gift hereunder. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Administrator. You may receive only one gift, no matter how many purchases you make. You may not enter more times than indicated by using multiple e-mail addresses, identities or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules your submission may be removed from eligibility at the sole discretion of Administrator.
5. How to Receive a Gift. The Giveaway is conducted on a first-come, first-served basis. A gift, chosen at checkout online, will be given to Qualified Purchasers who make a purchase on the Website. Your gift will be mailed to you with your purchase order at the address you enter on the Website.
6. Gifts/Prizes: Subject to these Rules, each Qualified Purchaser who makes a purchase of any product on the Website during the Giveaway Period shall receive one (1) bath bomb. Subject to availability, Qualified Purchaser will randomly receive one of the following bath bombs, subject to availability: Jason’s Mummy, Screamo, Screaming Banshee and Bat Art. No alternate products or credits are available.
You are not guaranteed to receive a gift and your chance of receiving a gift is dependent on the supply of gifts. No cash or other prize substitution permitted. Each gift is nontransferable. No substitution of gift or transfer/assignment of gift to others or request for the cash equivalent by any recipient is permitted.
7. Limitations: This Giveaway is conducted on a first-come, first served basis for Qualified Purchasers, while supplies last. The Giveaway is limited to one gift per Qualified Purchaser. No refunds, replacements or returns on gifts, even if damaged during delivery. The gift option is subject to availability. The gift is non-transferable.
8. Rights Granted by you: By purchasing product during the Giveaway Period you understand that Administrator, anyone acting on behalf of Administrator, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your purchase, including, without limitation, the purchase and receipient's name, portrait, picture, voice, likeness, image or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
9. Terms: Administrator reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway. In such case, Administrator may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Administrator. Administrator reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Giveaway or website or violates these Rules.
Administrator has the right, in its sole discretion, to maintain the integrity of the Giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same customer; multiple entries from the same customer in excess of that allowed by the Rules. Individuals who tamper with or attempt to tamper with the operation or entry process of the Giveaway or Website or violates these Terms will be disqualified by the Sponsor in its sole discretion. In its sole discretion, the Sponsor has the right to maintain the integrity of the Giveaway, to disallow multiple receipt of gifts for the same user; or the use of bots, macros, scripts, or other technical means for entering. Attempts by any Purchaser to deliberately damage any website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil laws. If any such attempt is made, the Sponsor reserves the right to seek damages to the fullest extent permitted by law.
By providing the Administrator your information for this Giveaway you agree to receive email newsletters periodically from Lush Internet Inc., and/or their respective affiliates. You can opt-out of receiving these communications at any time by clicking the unsubscribe link in the applicable newsletters.
10. Limitation of Liability: By accepting the gift you agree to release and hold harmless Administrator and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such Qualified Purchaser's participation in the Giveaway and/or your/his/her acceptance, possession, use, or misuse of any gift or any portion thereof.
11. Disputes: The parties waive all rights to trial in any action or proceeding instituted in connection with these Official Terms. Any controversy or claim arising out of or relating to these Official Terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Nevada.
THESE OFFICIAL TERMS AND THE INTERPRETATION OF ITS TERMS SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEVADA WITHOUT REGARD TO ITS CONFLICTS OF LAWS RULES.
