YOUR PARTICIPATION IN THE LUSH CLUB REWARDS PROGRAMME
1. Your participation in the Lush Club Rewards Programme (the “LUSH Club Rewards Programme”) is governed by this set of Terms and Conditions (the “Terms”).
2. Please read these Terms carefully. By participating in the LUSH Club Rewards Programme, you warrant that you have read, accepted and agreed to these Terms and our Website Terms (each as amended from time to time).
3. Please see how to join the LUSH Club Rewards Programme below.
JOINING THE LUSH CLUB REWARDS PROGRAMME
1. Enrolling in Lush Club Rewards: “Lush Club” is what we call the collection of additional Lush customer account features and benefits (“the LUSH Club”) available via your Lush Customer Account (“LUSH Customer Account”). In so far as it is relevant, the terms and conditions of your LUSH Customer Account are incorporated into these Terms and will prevail over these Terms to the extent of any inconsistency.
2. Access to and participation to the LUSH Club is only available in the LUSH Club Territories. The LUSH Club Rewards Programme is our customer rewards programme that you can find within Lush Club. You can only access the LUSH Club Rewards Programme to redeems benefits and rewards (“LUSH Club Rewards”) if you are a member of the LUSH Club.
3. Verification of Identity and Information: You may be required to verify your identity by supplying forms of identification and any other information reasonably required. This may include but is not limited to your current mobile telephone number, your email address, your surname and your date of birth, account and credit card information and verification of identity information.
You are responsible for the accuracy of any information that you enter. You must not provide any false, inaccurate, irrelevant, or misleading information.
4. Opting-in: Once you have joined the LUSH Club (“Lush Club Account”), if you are eligible (see Terms for eligibility criteria) you can choose to participate in the LUSH Club Rewards Programme. You will need to actively opt-in to join this by clicking on the relevant tab in the LUSH Club section of your LUSH Customer Account in the Lush website or app.
5. Minimum Age Requirement: The minimum age to join the LUSH Club Rewards Programme is the age of majority in your territory. The LUSH Club Rewards Programme is not targeted at children or intended for use by anyone under the age of majority in the Participating Territories. Lush customers who are above the age of majority in the jurisdiction in which they reside are eligible to join the LUSH Club Rewards Programme provided they do not reside in one of the Excluded Jurisdictions (see below). Lush employees are not eligible to join the LUSH Club Rewards Programme. If we identify that an individual who is under the age of majority in their territory is participating in the LUSH Club Rewards Programme, we reserve the right to remove them from the programme.
6. Purchase outside of LUSH Club Rewards Programme: If you do not wish to participate in the LUSH Club Rewards Programme, you may still make purchases through ‘guest checkout’ or whilst logged into the LUSH Club if you have not signed up to LUSH Club Rewards Programme.
7. What happens to my LUSH Club Rewards if I close my Lush Customer Account?
If you already have a LUSH Customer Account and you wish to close your account, you can do so by emailing:

For the avoidance of doubt, all future orders must then be placed through ‘guest checkout’. Please be aware that if you close your LUSH Customer Account or your LUSH Club Account, this will automatically remove your access to the LUSH Club Rewards Programme and you will permanently lose access to all LUSH Club Rewards Programme Points and LUSH Club Rewards accrued. You cannot access the LUSH Club Rewards Programme without a Lush Club account.
8. What happens to my LUSH Club Rewards if I am an inactive member?
An “Inactive Member” is defined as a member of the LUSH Club Rewards Programme who has not earnt any points under this programme in a consecutive 24 month period.
If you become an Inactive Member, we reserve the right to remove you from the LUSH Club Rewards Programme. Upon being removed from the LUSH Club Rewards Programme, you will lose all accrued rewards, points and level status.
We will notify you by email at least 30 days before your LUSH Club Rewards Programme profile is removed giving you an opportunity to continue participating in the programme. If your profile is removed due to inactivity, you may re-join the programme at a later date. Your previous points, level and rewards will not be carried over.
9. Inappropriate and offensive content: LUSH Club Reward Programme participants shall not, while engaging with LUSH Club or the LUSH Club Reward Programme, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to be ambush marketing, or content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights).
GLOBAL RESTRICTIONS TO THE LUSH CLUB REWARD PROGRAMME
1. LUSH Club Rewards Programme Territories: LUSH Club Rewards are available for customers who join the LUSH Club and sign up to LUSH Club Rewards Programme in the following countries:
a. Australia
b. New Zealand
(“LUSH Club Territories”)
2. LUSH Club Rewards Programme participation is territory specific. We only allow one (1) LUSH Club Accountper person. Any orders made outside the LUSH Club Territory you reside in will not count towards your LUSH Club Rewards Programme Points or LUSH Club Rewards.
3. LUSH Club Rewards Programme profile Limit: There is a limit of one (1) LUSH Club Account per person.
a. If you wish to participate in the LUSH Club Reward Programme in another LUSH Club Territory you will have to first close your existing LUSH Club Account and open a new LUSH Club Account in the new LUSH Club Territory. Please be aware that your LUSH Club Rewards Programme Points, levels, and rewards are specific to the particular LUSH Club Territory in which you created the account, and are not transferable, and cannot be exchanged for cash.
b. Duplicate LUSH Club Rewards Programme Profiles: If the same person is enrolled in the LUSH Club Rewards Programme more than once in the same LUSH Club Territory (including under different names or addresses or email addresses) we reserve the right to remove them from the LUSH Club Rewards Programme.
3. LUSH CLUB REWARDS PROGRAMME POINTS, LEVELS AND REWARDS
1. Where can I find the LUSH Club Rewards Programme online? Once logged in to your LUSH Customer Account on the Lush website or app , details of your LUSH Club Rewards Programme Points and rewards will be available in the Lush Club section of your LUSH Customer Account.
2. Where can I find the LUSH Club Rewards Programme app? Your Lush Club Rewards Programme will be accessible within the “Rewards” tab on your Lush Club account page on the Lush website or app.
LUSH CLUB REWARDS PROGRAMME POINTS
3. Points are automatically added to a LUSH Club Account based on the value in whole dollars of an Eligible Action from that account (“LUSH Club Rewards Programme Points”), for example: if you spent AU$/NZ$2 on a Lush Product, you would earn 1 LUSH Club Rewards Programme Point. If you spent AU$/NZ$3.99 on a Lush product, you would earn 2 LUSH Club Rewards Programme Points.
4. An “Eligible Action” can be:
Purchase of Lush products using the Lush app, Lush Australia/ Lush New Zealand website, or in participating Lush Australia/ Lush New Zealand stores when logged into or presenting your LUSH Club Rewards Programme profile at the time of purchase (if you are signed up to the LUSH Club Rewards Programme).
Purchase of a Lush Delivery Pass 12 month subscription (Delivery Pass is not available in all territories). The LUSH Club Rewards Programme Points will be accumulated once payment has cleared for the purchase of the subscription.

Payment of your monthly Lush Kitchen subscription. The LUSH Club Rewards Programme Points will be accumulated once payment has cleared for the relevant month’s payment. (Lush Kitchen Subscription is not available in all territories and is subject to the Lush Kitchen Subscription Terms and Conditions https://www.lush.com/au/en/faq/subscription-kitchen-faq-au).
Purchase of Lush Store Parties. The LUSH Club Rewards Programme Points will be accumulated once payment on the has been cleared.
LUSH Club Rewards Programme Points are earnt once a Lush gift card is spent.
5. The following are ineligible actions that you cannot earn LUSH Club Rewards Programme Points for:
There are no LUSH Club Rewards Programme Points earnt on the purchase of Lush gift cards.
There are no LUSH Club Rewards Programme Points earnt on the purchase of tickets for Lush Events.
There are no LUSH Club Rewards Programme Points earnt on purchases of products or services in concessions within our Lush stores.
6. In order to qualify as an Eligible Action, a purchase action must be made by you for products via www.lush.com/au / www.lush.com/nz in your LUSH Club Rewards Programme Territory or the Lush app (while logged in to your LUSH Customer Account), or in selected participating Lush stores (“Participating Store”)in the LUSH Club Territories (“Valid Order”). Orders that are subsequently returned or cancelled will not be considered Valid Orders
7. From time to time, we, in our sole discretion, may change, discontinue, or add interactions where you can earn LUSH Club Rewards Programme Points and change the number of LUSH Club Rewards Programme Points earned, with or without prior notification to you.
8. LUSH Club Rewards Programme Points cannot be retrospectively applied to Valid Orders. It is Your sole responsibility to ensure you present your LUSH Club barcode at the tillpoint before the transaction is completed in Participating Stores. If purchasing online through Lush website or app, you must be logged into your LUSH Customer Account and have joined the LUSH Club Programme to earn LUSH Club Rewards Programme Points on a Valid Order.
9. Purchase of virtual consultations, shipping (apart from the Delivery Pass Subscription), monetary value of samples, monetary value of any complimentary full-sized product and applicable taxes will not count towards a Valid Order and are excluded.
10. LUSH Club Rewards Programme Points can be used to unlock LUSH Club Rewards. Each LUSH Club Reward is subject to the applicable Rewards Terms and Conditions stated on the reward card. Please read these before using the LUSH Club Reward.
11. LUSH Club Reward Programme Points have no cash value and may not be sold, transferred or exchanged.
LUSH CLUB REWARD PROGRAMME LEVELS
1. When you place a Valid Order, you will earn LUSH Club Reward Programme Points. You move up to the next level in the LUSH Club Rewards Programme when you reach the next 100 point threshold.
2. The only way to reach a higher LUSH Club Reward Programme Level is to accumulate LUSH Club Rewards Programme Points.
3. Details on the LUSH Club Rewards Programme Levels and the LUSH Club Rewards Programme in general can be found on https://www.lush.com/au/en/l/club or https://www.lush.com/nz/en/l/club
4. There are no LUSH Club Rewards linked to reaching a new level. All LUSH Club Rewards are linked to LUSH Club Reward Programme Points accumulation only.
LUSH CLUB REWARD PROGRAMME: POINTS & REWARDS
1. How do I find the Rewards? LUSH Card Rewards under this LUSH Club Reward Programme become available when you reach a specific points threshold (each relevant LUSH Club Reward will show the number of LUSH Club Reward Programme Points required to unlock it on the reward itself).
2. How do I unlock the Rewards? When you reach the number of LUSH Club Reward Programme Points associated with a specific LUSH Club Reward, it will appear in your LUSH Club Reward Programme tab in your LUSH Club Account. The LUSH Club Reward will show as automatically unlocked.
3. How long do I have to use an unlocked Reward? Please read the LUSH Club Reward terms and conditions stated on the specific reward to find the expiry date. It is your responsibility to check the expiry date and make sure you use it in time. Once an unlocked LUSH Club Reward expires, it will no longer be available for use.
4. Does unlocking or using a Reward affect my Points level? When you select a LUSH Club Reward that is showing as available in your LUSH Club Rewards Programme tab, your points level will remain the same. LUSH Club Rewards Programme Points cannot be spent, as they have no monetary value.
5. How do I redeem a Reward? Each LUSH Club Reward will specify where it can be redeemed and other terms about the reward. LUSH Club Rewards have individual expiry dates on them (as detailed in your LUSH Club Account) and will be removed from your LUSH Club Account once expired.
6. Do my points expire or reset? LUSH Club Reward Programme Points and LUSH Club Rewards will also expire if:
Your participation in the LUSH Club Rewards Programme is terminated (either voluntarily by you, or by us due to your breach of these Terms); Your LUSH Customer Account is closed (as this automatically closes all LUSH Club features).
7. Rewards accessed under this LUSH Club Rewards Programme cannot be used in conjunction with any other promotion.
REFUNDS ON ORDERS
1. What happens to my points? If a Valid Order is refunded or cancelled where LUSH Club Rewards Programme Points were accumulated, the accumulated LUSH Club Rewards Programme Points will be removed from your points balance.
2. What happens to my reward? You must also return any LUSH Club Reward received when returning your order.
USE OF ACCOUNT
You are responsible for maintaining the security and confidentiality of your customer account and password, and are fully responsible for any and all activities that occur under your password or account. The LUSH Club Rewards Programme is for your personal use only. You must not share your LUSH Club Rewards identification and/or password or in any way make them accessible to others. You must immediately inform our Customer Care team of any unauthorised use of your password or account or any other breach of security. To protect your personal information and sensitive information, we may restrict access to your account until your identity can be verified. We is not liable for any claims or losses that you may incur in relation to someone else using your account.
You agree that you shall not:
access, use, reproduce, modify, download, sell, transfer, publish or otherwise make available your membership of the LUSH Club Rewards Programme for any commercial purposes;
do any act or thing that might damage, disrupt or otherwise interfere with the operation of the LUSH Club Rewards Programme;
abuse your membership of the LUSH Club Rewards Programme or use it for any unlawful or unauthorised purpose (which include transmitting any computer viruses through your account or using your account in a manner which is discriminatory, offensive, abusive, malicious, defamatory or other violates or infringes the rights of anyone else); and
transfer, sale or barter (or attempt to transfer, sale or barter) any of your rewards or member exclusive promotional offers.
DATA PROTECTION
1. The personal information collected, used, and stored to manage LUSH Club Rewards for Participants is described in our Privacy Policy:

2. By enrolling in the LUSH Club Rewards Programme, you confirm that you have read and understood how we use your personal information as described in the relevant Privacy Policy is incorporated into and forms part of these Terms . This includes using your personal information to manage your membership, personalise your experience, award points when you make purchases, allow sending updates about Rewards that have become available and Rewards that are due to expire, the LUSH Club Rewards Programme, and protect against fraud.
TERMINATION; EXPIRATION; CHANGES TO LUSH CLUB REWARDS
1. Error, Fraud, Deception: We reserve the right to revoke some or all of your LUSH Club Rewards Programme Points or rewards if we determine that you received LUSH Club Rewards Programme Points or a reward due to an error, through fraud or deception, or in any manner not authorised.
2. What happens if my LUSH Club Rewards Programme Membership is cancelled? If you or we cancel your LUSH CLUB Account, you will lose all your accumulated LUSH Club Rewards Programme Points. If you cancel your LUSH Club Account , you may choose to rejoin the LUSH Club Rewards Programme by registering on the Lush website or app. When restarting your LUSH Club Rewards Programme membership, your previously-earned points will not continue to your new membership.
3.Changes to the LUSH Club Rewards Programme: Where permitted by lawLush reserves the right to change these Terms including the eligibility, levels and rewards available under the LUSH Club Rewards Programme at any time; and to terminate or withdraw the LUSH Club Rewards Programme including revoking all earned LUSH Club Rewards Programme Points, LUSH Club Rewards and levels; or close further participation in the LUSH Club Rewards Programme, at any time in its discretion. Lush will not be liable for any resulting loss or damage, or compensation to a participant of the LUSH Club Rewards Programme as a result of suspension or cancellation of LUSH Club or the LUSH Club Rewards Programme, or any loss of Points, Rewards or Levels associated with that LUSH Club Reward profile account.
4. Where permitted by law, unless we notify you otherwise, any amended Terms will be effective immediately and your continued participation in LUSH Club after the amended Terms are posted will confirm your acceptance of the changes. Therefore, you should review these Terms regularly to understand the terms and conditions that apply to LUSH Club. If you do not agree to the amended Terms, you must not continue to participate in the LUSH Club Rewards Programme and contact us immediately by email at Customer Care Lush Australia ([email protected]) or Customer Care Lush New Zealand ([email protected]) [email protected] so that we can close your LUSH Club Rewards Programme profile.
5. Cancellation of your LUSH Club Rewards Programme Profile: Where permitted by law we reserve the right at our sole discretion to remove any LUSH Club Rewards Programme Participant from further (or any) use of the LUSH Club Rewards Programme if we have reason to believe that LUSH Club Rewards Programme Participant is: (a) tampering with the operation of the LUSH Club Rewards Programme (b) or is acting in any manner deemed by Lush to be in violation of these Terms, any Lush website or app terms, relevant laws and/or regulations and/or third party rights; or (c) engaged in any deception, forgery, fraud or committed any other abuse of the LUSH Club Rewards Programme. If we do so, any points, rewards, and levels that the LUSH Club Rewards Programme Participant may have become entitled to by participating in the LUSH Club Rewards Programme are void with immediate effect.
DISCLAIMER, WARRANTY EXCLUSIONS AND LIMITATION OF LIABILITY
1. You acknowledge and agree that use and acceptance of the LUSH Club Rewards Programme is at your sole risk.
2. By participating in the LUSH Club Rewards Programme, you indemnify us against any and all actions, claims, damages, expenses or liabilities suffered or incurred directly or indirectly by us in consequence of any breach or alleged breach, non-performance or non-observation of any agreement, conditions, obligation or warranty on your part. You hereby waive and release us and each of our parent, affiliated, subsidiary and/or related entities and parties from any claim, action or demand arising out of or in connection with your participating in the LUSH Club Rewards Programme.
3. To the maximum extent permitted by law, we are not responsible for any damage or loss suffered by you where such damage or loss was not a reasonably foreseeable consequence of a breach of these Terms, or where the LUSH Club Rewards Programme does not run as planned.
4. To the maximum extent permitted by law, we will not accept responsibility for equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
5. To the maximum extent permitted by law, we will not be held responsible for the failure to fulfil the obligations of third parties involved in the LUSH Club Rewards Programme, although we will always endeavour to minimise the effect to the participants of any such failure.
6. To the maximum extent permitted by law, we will not accept responsibility for any liability arising in connection with any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
7. To the fullest extent permitted by law, we, including our officers, employees, agents and contractors, disclaim all warranties and representations of any kind (whether express or implied) and will not be liable for any direct or indirect damage (including special and/or consequential damage, such as loss of business, loss of profits or loss of data) which results from use or access of, or LUSH Club Rewards Programme.
8. Without limitation to the foregoing, we acknowledge that the laws in LUSH Club Territories may imply warranties and conditions or impose obligations on the supply of goods and services which cannot be excluded, restricted or modified except to a limited extent. If any such laws apply, then to the fullest extent permitted by the law of the relevant LUSH Club Territories and in the case of Australia, to the extent permitted by The Australian Consumer Law in the Competition and Consumer Act 2010 (Cth), and in the case of New Zealand, to the extent permitted by the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 we limit our liability and if any liability remains it will be limited to any one or more of the following in its sole discretion:
in the case of any goods, the replacement or repair of the goods, or the supply of equivalent goods, or the payment of the cost of repairing or replacing the goods or supplying equivalent goods; and
in the case of any services, the supply of the services again or the payment of the cost of having the services supplied again.
GENERAL
1. The LUSH Club Rewards Programme is for personal use only. Participation is not open to companies, businesses, charitable organisations, corporations or any entity other than an eligible individual. Customers using the LUSH Club Rewards Programme to benefit from commercial use by purchasing items to resell are not eligible to participate and will be removed from this programme. All rewards and points associated with deactivated accounts will immediately become void.
2. Each of the clauses of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining clauses will remain in full force and effect. If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
3. Subject to clause 4(b) below, LUSH and its group companies accept no responsibility for any damage, loss, injury or disappointment suffered by any person as a result of their participation in the promotion, their attempted participation or their acceptance of any product. b. Nothing in these Terms shall exclude LUSH’s liability for death or personal injury as a result of its negligence, or for fraud or fraudulent misrepresentation, or for any other liability which may not be lawfully limited or excluded under English law. c. By participating or attempting to participate in this promotion, participants agree that LUSH shall not bear any liability for: the loss, theft or misuse of any product; or any damage in any way attributable to this promotion or the attempted participation in this promotion, subject to clause (b) above.
4. These Terms are governed by:
a. In Australia: the laws of New South Wales. In the event of any matter or dispute arising out of or in connection with these Terms, you and we shall submit to the exclusive jurisdiction of the courts of New South Wales. This does not affect the applicable mandatory rights under the law of your country of residence.
b. In New Zealand: the laws of New Zealand. In the event of any matter or dispute arising out of or in connection with these Terms, you and we shall submit to the exclusive jurisdiction of the courts of New Zealand. This does not affect the applicable mandatory rights under the law of your country of residence.
5. The LUSH Club Rewards Programme is operated by:
a. In Australia: Lush Australasia Retail Pty Limited (‘Lush’) (ABN 24 077 737 663) of Unit 1A, 74-76 Biloela St, Villawood, NSW 2163. Our registered business name is Lush Fresh Handmade Cosmetics (“Lush”, “we”, “us” or “our”).
b. In New Zealand: Lush (New Zealand) Limited (‘Lush’) (GST #: 69499813) our Registered Address is 162 Foundry Road, Silverdale Auckland New Zealand 0932. Our registered business name is Lush Fresh Handmade Cosmetics (“Lush”, “we”, “us” or “our”).
c. Customers that participate in the LUSH Club may be referred to as “Participant”, “Member”, “you”, or “your”.
